(1) These Terms of Service govern the use of the Video Creator tool on goru.rocks (hereinafter ‘Platform’), operated by Marvin Rüßbüldt, c/o IP-Management #8928, Ludwig-Erhard-Str. 18, 20459 Hamburg, Germany (hereinafter ‘Operator’).
(2) The Platform allows registered users to create animated group chat videos. Features depend on the selected plan (Free, Starter, Pro).
(3) Deviating conditions of the user are not recognized unless the Operator expressly agrees to their validity in writing.
(4) The current version of these Terms is available at goru.rocks/terms.
(1) Using the Platform requires registration via Google OAuth or Discord OAuth.
(2) Only one account per person is permitted. Creating multiple accounts to circumvent usage limits is prohibited.
(3) The minimum age for use is 13 years.
(4) The user is responsible for account security. Sharing login credentials with third parties is prohibited.
(5) Violation of subsection 2 or 4 entitles the Operator to immediately suspend the account without refund.
(6) Only one active session per account is permitted at any time. Logging in on a second device automatically terminates the existing session.
(1) The Platform provides a web-based tool for creating animated group chat videos. Users select countries, write messages, and receive a rendered video.

(3) Design Packs and Limited Drops are available as one-time purchases independent of the subscription plan.
(4) The Operator reserves the right to modify the scope of the free plan at any time. Paid plans retain at least the features guaranteed at the time of purchase.
(1) All videos created through the Platform carry a “made with goru.rocks” watermark.
(2) The watermark is an integral part of the video and is burned into the video server-side.
(3) Removing, covering, cropping, overlaying, or otherwise obscuring the watermark is expressly PROHIBITED.
(4) Violation of subsection 3 entitles the Operator to immediately suspend the account without refund.
(5) The size and position of the watermark depends on the selected plan (Free: large and centered at the bottom, Starter/Pro: small and subtle at the bottom right).
(1) Users are solely responsible for the content of their created videos.

(3) The Platform employs automated content filters. After repeated violations (3 warnings), the account is automatically suspended.
(4) No refund of paid amounts will be issued for suspensions due to violations.
(1) Users receive a simple, non-exclusive right to use their created videos on social media and other platforms. The watermark must remain visible at all times.
(2) If the user opts in to the Community Gallery, the Operator receives the right to display the video on the website, TikTok, Instagram, YouTube, and other channels. Credit will be given to the creator.
(3) Gallery consent can be revoked at any time. The video will then be removed from the Gallery and all Operator channels.
(4) If the user opts in to Story Usage (separate opt-in), the Operator receives the right to use the storyline (country selection, message content, plot) as inspiration for own videos. The user’s video will not be reposted; only the concept will be used. Individual credit is not provided.
(5) Story Usage consent can be revoked at any time for future use. Already published videos by the Operator based on the storyline will remain.
(6) Without opt-in per subsection 2 or 4, the Operator receives no usage rights to created videos or storylines.
(7) The user must not create the impression of having developed the Video Creator tool or being the creator of the goru.rocks platform. The ‘made with goru.rocks’ label must not be removed, altered, or replaced with own attributions.
(1) Payment is processed through the payment service provider Stripe. The Operator does not store payment data.
(2) Subscriptions (Starter, Pro) automatically renew for the selected period (monthly).
(3) Design Packs and Limited Drops are one-time purchases and non-refundable.
(4) Subscriptions can be cancelled at any time, effective at the end of the current billing period. There is no minimum contract term.
(5) No refund is provided for already paid periods, except where legally required.
(6) The Operator reserves the right to adjust prices for new products and plans. For existing subscriptions, the prices agreed at the time of purchase apply until the next renewal period.
(1) You have the right to withdraw from this contract within 14 days without giving any reason.
(2) The right of withdrawal expires for digital content once the user has begun using the content and has previously expressly consented to early performance and acknowledged the loss of withdrawal rights.
(3) For subscriptions: withdrawal may be declared within 14 days of the first purchase, provided no service has been used.
(4) For one-time purchases (Design Packs, Limited Drops): the right of withdrawal expires upon immediate provision of the digital content after express user consent.
(1) Limited Drops are time-limited design offerings that are permanently removed after the offer period ends.
(2) The first 100 buyers of a Limited Drop additionally receive an individual serial number in the video and an exclusive badge in their user profile.
(3) From the 101st buyer onwards, the identical design is sold without serial number and without badge.
(4) Refunds for Limited Drops are excluded as they are time-limited digital content. Users are informed of this before purchase.
(5) The Operator guarantees that no further copies of the respective design will be sold after the offer period ends.
(1) The Operator strives for high availability of the Platform.
(2) There is no entitlement to uninterrupted availability. The Operator is not liable for outages due to force majeure, maintenance, or disruptions at third-party providers.
(3) Maintenance work will be announced in advance where possible.
(4) Rendered videos are automatically deleted from the server after 24 hours, unless the user has consented to storage in the Community Gallery.
(5) The Operator reserves the right to discontinue the Platform at any time. Active subscriptions will be terminated at the end of the already paid period and refunded proportionally. Design Packs and Limited Drops are digital goods fully delivered upon purchase; no refund is provided upon discontinuation of the Platform. The Operator will announce the discontinuation at least 30 days in advance via email.
(6) Upon discontinuation, all personal data will be deleted in accordance with the Privacy Policy.
(1) The Operator is only liable for intent and gross negligence.
(2) Liability for slight negligence is excluded unless essential contractual obligations are affected.
(3) The Operator is not liable for user-generated content.
(4) The Operator is not liable for technical limitations or quality reductions resulting from the selected plan (e.g., resolution, framerate).
(5) Liability is in any case limited to the amount the user has paid to the Operator in the last 12 months.
(1) The Operator collects and processes personal data exclusively in accordance with the GDPR and the Privacy Policy at goru.rocks/privacy.
(2) Users have the right to access, rectification, deletion, and data portability of their personal data.
(3) Users can delete their account completely at any time. All personal data will be deleted and the Stripe subscription cancelled.
(1) The Operator may amend these Terms with effect for the future.
(2) Changes will be communicated to the user via email or through the Platform.
(3) If the user does not object within 30 days of receiving notice, the amended Terms are deemed accepted. The user will be specifically informed of this consequence in the notice.
(4) If the user objects, the Operator may terminate the contractual relationship at the end of the current billing period.
(1) The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods.
(2) Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions remains unaffected.
(3) The European Commission provides an online dispute resolution platform: https://ec.europa.eu/consumers/odr. The Operator is not obligated and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
